Appropriate Usage Policy (AUP)

Philosophy

    dbCanvas does not want to be involved in policing the Internet. We support free speech. Unfortunately, a certain small percentage of users abuse the system. The Internet won't work if people spam, or hack, or engage in other abusive activities. Our policy is designed to prevent system abuse and to give us legal recourse in the event of system abuse.

Adult Content

    Pornography and sex-related merchandising are prohibited. This includes sites that may infer adult or sexual content. This also includes links to Adult Content elsewhere.
    Any individual(s), organization(s) and or company(s) that knowingly or otherwise directly or indirectly have Adult Content on their site may have their account canceled. dbCanvas shall not refund any fees paid in advance of account cancelation. Anyone with Adult Content on their site agrees to compensate dbCanvas for any fees incurred including addtional bandwidth charges and any legal expenses.

SPAM

    If everyone with a product to sell or an opinion to voice sends an email to every person on the Internet, the system will be swamped and become unusable. If people were allowed to Spam from dbCanvas servers then dbCanvas would soon be blacklisted.
    dbCanvas does not allow the practice of Spamming. If we find anyone utilizing our network, directly or indirectly, for Spamming, their dbCanvas account will be subject to termination with no refund.
    We will, to the fullest extent allowed by law, seek legal action on any individual(s), organization(s) and or company(s) that knowingly or otherwise directly or indirectly utilize our Network (or cause to be used) for any practice that sends out mass unsolicited e-mail. Spam is considered unauthorized abuse of the system, and we consider it to be a form of hacking. All penalties for Hackers may apply to Spammers.

What is spam?

    Spam is any unsolicited message sent to a large number of people.
It is Spam if:
  • The recipient did not request the message.
  • Its a mailing list and the recipients did not actively choose to be on the list. Passive registration of list recipients is not adequate.
  • Its a purchased mailing list.
  • Its a mailing list of names obtained from newsgroups.
  • Its a chain letter.
  • It mentions any kind of multi-level marketing.
    If you are a customer of dbCanvas, and spam in any way it is a billable violation of our policy.

Hacking

    Any individual(s), organization(s) and or company(s) that knowingly or otherwise directly or indirectly utilize any of our servers or equipment to hack, will be subject to and agrees to compensate dbCanvas, $10,000.00 per occurrence. In addition, we will, to the fullest extent allowed by law, seek legal action on any individual(s), organization(s) and or company(s) that knowingly or otherwise directly or indirectly utilize our Network (or cause to be used) for any practice that we consider to be 'hacking'.

Fees for Time and Expenses

    Hackers and spammers tie up our time and resources. dbCanvas is a for profit business, and we need to charge for this time Anyone who hacks or spams, agrees to compensate dbCanvas for:

  • Time and expense for tracking down the hacker/spammer.
  • Time and expense collecting fees from the hacker/spammer.
  • Time and expense relating to repairs, down time, or system upgrades which are related to hacking/spamming or the prevention thereof.
  • Time and expense relating to prosecution or attempted prosecution of the hacker/spammer.
  • Time spent tracking or dealing with hackers will be billed at $200/hour.
  • Legal expenses.
  • These expense fees are in addition to the $10,000 per occurrence, the fee for system abuse incidents.

What is hacking?

    Hacking is the interference with or uninvited access to any computer, with malicious intent. Hacking is harmful primarily because it costs us valuable time. Our intention is to charge enough for abuse, that it will not seem attractive. Hacking includes:

  • Any attempt to gain root or system administrator privileges on any dbCanvas network machine or equipment, without permission.
  • Any attempt to gain access to files, equipment or accounts, which you don't own, unless you have permission.
  • Any attempt to do anything, which results in interruption of any service to dbCanvas customers.
  • Any use of chat robots.
  • Any attempted use of password cracking software.
  • Denial of Service
  • Any attempt to access or change system files, without permission.
  • User files are kept in predefined areas. These include the user home directory, the user web directory, and the user mail area, and any other areas assigned by dbCanvas. Any attempt to place or modify files in any other area, without specific permission is hacking.
  • Installation or attempted use of SUID programs of any type, without permission.
  • Any attempt to do these things through dbCanvas, even if the attempt is aimed outside our network, is a hacking event and will be treated the same as if the attack were against the dbCanvas system.

If You Use the System, You Agree to these Policies

    Use of the dbCanvas constitutes agreement to these policies. It is your responsibility to read them an understand them.

Please report any hacking, spamming or other abuse to the dbCanvas Abuse Department.
